For general schedule and certain other categories of employees, premium night pay is a 10 percent differential paid to an employee for regularly scheduled work performed between 6 p.m. and 6 a.m.

For wage system employees, the differential is 7.5 percent for work on a second shift (defined as the majority of hours falling between 3 p.m. and midnight) and 10 percent for regularly scheduled work on the third shift (defined as the majority of hours falling between 11 p.m. and 8 a.m.).

Night Pay is Additional

Night pay is paid in addition to overtime, Sunday, or holiday premium pay and is not included in the rate of basic pay used to compute overtime, Sunday or holiday pay.

In computing a night pay differential, the employee’s basic rate of pay, including locality-based payments, special pay adjustments for law enforcement officers and continued rates of pay are included.

An employee is entitled to a night pay differential for a period when he or she is excused from night work on a holiday or other non-work day and for night hours of the tour of duty while in an official travel status, whether performing actual duty or not. An employee is entitled to a night pay differential for a period of paid leave only when the total amount of that leave in a pay period, including both night and day hours, is less than eight hours.

An employee is entitled to a night pay differential when he or she is temporarily assigned during the administrative work week to a daily tour of duty that includes night work. This temporary change in a daily tour of duty within the employee’s regularly scheduled week is distinguished from a period of irregular or occasional overtime work in addition to the employee’s regularly scheduled work.
