The Office of Special Counsel has said that a long-running case involving the Hatch Act has ended with the dismissal of a federal employee who it said ran as a candidate for partisan political office “numerous times” over a decade.

OSC had first issued a warning to the employee in 2012 and filed a complaint against him before the MSPB in 2016, it said, and an initial decision by a hearing officer held that the employee should be removed.

However, the employee challenged that decision to the merit board, which at the time was beginning a five-year stretch in which it could not issue decisions because of a lack of members.

During that time, the employee had continued running for the same office every two years, including in 2022, identifying himself on his campaign website as a federal employee and referencing his position, the OSC said.
