Meanwhile, the Army reports that it received 127 challenges of its listing of positions subject to contracting-out as required by the Federal Activities Inventory Reform (FAIR) act. The large majority of the challenges came from federal employees and unions contesting the Army’s determination that certain positions were subject to contracting although some came from contractors questioning the determination that certain civil service positions were not subject to contracting. The Army has denied all but nine of the challenges, involving labor relations and contracting office functions.
