Contracting Bill Has New Requirements for Making Awards

Legislation has been introduced to block contractors with poor performance records from getting government contracts.

The Federal Contracting and Oversight Act, S-3323, would expand access to the Federal Awardee Performance and Integrity Information System database to all members of Congress, as well as require contractors to fulfill FAPIIS reporting requirements prior to receiving an award.

The bill, introduced by Sens. Russ Feingold, D-Wis., and Tom Coburn, R-Okla., would require an annual audit of the contract files required under the Clean Contracting Act of 2008 to ensure that federal contracting officials are appropriately consulting and considering the FAPIIS database prior to making contract award decisions.

It would also require reporting on misconduct by contractors in connection with non-governmental contracts to help federal personnel identify companies with a history of problems.

Further, the bill orders OMB and GSA to come up with a plan to consolidate several contracting databases into a single, searchable and linked network.

Those systems include the excluded parties list system, the central contractor registry, the contractor performance assessment reporting system, and USASpending.gov.
