EEOC Cites Common Errors in Dismissing Discrimination Complaints

The Equal Employment Opportunity Commission has released a report identifying common errors by agencies when dismissing discrimination complains on procedural grounds.

According to the report, “Preserving Access to the Legal System: Common Errors by Federal Agencies in Dismissing Complaints of Discrimination on Procedural Grounds,” dismissal decisions may be appealed by complainants to the EEOC, which reverses about a third of the cases it receives each year.

EEOC’s Office of Federal Operations found that 81 percent of the EEOC’s reversal decisions involved only two regulatory grounds for dismissal: failure to state a claim and failure to comply with regulatory time limitations.

EEOC noted that OFO has a training course available on procedural dismissals for agency EEO personnel through its EEO Training Institute.
