OPM and FLRA will conduct an online training session October 28 starting at noon Eastern time on labor-management issues on President Biden’s executive order overturning Trump administration orders on a range of issues related to bargaining and disciplinary matters.
The presentation will address topics including “the administration’s perspective,” and “best practices and advice regarding successful bargaining” with an emphasis on topics that are negotiable at management’s discretion under federal labor law.
The administration also has told agencies to bargain over discretionary topics—so-called “(b)1” matters, named for the section of law where they are found, in contrast to the prior order barring bargaining on those topics. Those include the numbers, types and grades of employees or positions assigned to any organizational subdivision, work project, or tour of duty, and the technology, methods and means of performing work.
