Eligibility for Children of Partners Ending

One change in eligibility for the 2016 year in FEHB during the current benefits open season is that OPM has rescinded eligibility that took effect in 2014 under FEHB and FEDVIP for children of same-sex domestic partners when the couple lives in a state that doesn’t recognize same-sex marriage and certifies that they would marry if their state allowed it. That policy has been overtaken by the June U.S. Supreme Court ruling that requires all states to license and recognize same-sex marriage, OPM said. Those already covered based on such a certification remain eligible only to the end of this year. For plan year 2016 and beyond, couples must be married in order to cover a child as a stepchild under FEHB and FEDVIP.
