OPM has sent guidance to agencies (BAL 06-801) regarding what happens when employees enrolling in flexible spending accounts erroneously choose a health care account or a dependent care account when they meant to choose the other (employees may enroll in either, both or neither). OPM told agencies that such mistaken elections can be corrected via account funds transfer so long as there is clear and convincing evidence that the election was indeed mistaken. Separately, OPM issued guidance to agencies (BAL 06-205) regarding the processing of FEGLI claims and other forms, saying that FEGLI enrollees and beneficiaries “have expressed concerns about the accuracy and timeliness of information they receive.” The guidance covers issues including certification of insurance status, agency responsibilities when an enrolled employee dies, and the requirement that certain forms be originals, not copies.
