Legal Issue Could Steer Outcome of Reforms

With working time in the current Congress already running short, even VA officials have called for renewed attention to the reform effort. The House last year passed a bill to shorten the appeals process for all other VA employees who currently have MSPB appeal rights—some in medical professions can appeal only to internal review boards—although that bill too would eliminate the role of the governing board and raises similar legal issues. The Senate version would retain that role while shortening the process for non-executives; executives instead could appeal only in-house, with time limits set on that process, as well. After quickly advancing initially, that plan has been stalled by criticisms from some that it is too restrictive and from others that it is too lenient. Both plans contain numerous other provisions affecting employees such as enhanced whistleblower protections and restrictions on use of paid administrative leave that, like shortening the appeals process, are generally seen as a potential model for similar changes across government.
