The Department of Homeland Security has agreed to delay by two weeks, until August 15, the implementation of its new personnel system. A federal judge hearing a union suit against the rules asked for that delay in order to give her more time to issue a more complete ruling. DHS issued final regulations earlier in the year but to date has not put out implementing guidance that will be needed to make many of the policy changes operational. DHS has circulated draft guidance in areas including labor-management relations and adverse actions and appeals that on the whole provide few new details regarding the department’s intent. DoD has not yet issued final regulations; a report to Congress on the recently concluded “meet and confer” period with unions must come first, and DoD could not put out final rules until at least 30 days afterward. A union suit against DoD also is pending.
