The legal fight over certain aspects of DoD’s national security personnel system, could continue for many more months, with federal unions saying they will ask the U.S. Supreme Court to take up the case following a decision by the U.S. Court of Appeals for the District of Columbia Circuit to refuse a full-court review of the dispute. Earlier this year a three-judge panel of that court voted 2-1 against the unions’ challenge to the labor relations and appeals rights provisions of NSPS, overturning a lower court judge who last year ruled in favor of the unions. The unions indicated that they plan to file a formal review by early November, and given the time involved in the process of filing responses and other briefs, it could be into next year until the high court is even ready to think about whether it wants to take up the case. Many more months could pass before oral arguments are held and an opinion issued.
