The Office of Management and Budget has proposed revisions to its Circular A-76, the guidance on putting federal jobs up for private sector performance, that in sum are designed to encourage agencies to consider contracting out federal jobs not deemed inherently governmental and make public sector/private sector competitions operate more like competitions between two private sector bidders on government contracts. The plan includes authority-starting with information technology work and potentially expanding into other areas-to award work to the bidder providing the “best value,” not necessarily the lowest bid, as is done today. The changes also would speed up and simplify the process, setting a goal of 12 months start to finish, compared with three or four years commonly needed under current policy. Most of the changes are to be made administratively, probably soon after a 30-day comment period expires, although in some cases changes in law will be needed.
