Other Restrictive Language Abounds

Other restrictions on contracting policy in the pending appropriations bills include:

the House-passed Science-State-Justice Commerce bill (HR-5672), to prohibit carrying out the 2003 revisions to the Circular A-76 contracting-out guidelines at covered agencies until in-house employees have the same appeal rights as contractors; the House- and Senate-passed bill for the Department of Homeland Security (HR-5441) that continues a ban on contracting-out of immigration information officers, contact representatives, or investigative assistants in the Citizenship and Immigration Services bureau; the House-passed Interior bill (HR-5386), which would bar the use of funds for competitive sourcing on studies related wildlife management and would place other restrictions on contracting-out by agencies in the bill, including restrictions on contracting for feasibility studies (the pending Senate version contains similar language); the House- and Senate-passed DoD bill (HR-5631), which bars bidding companies from gaining an edge there by not offering health insurance to their employees; the House-passed energy and water development bill (HR-5427) that bars contracting-out of Army Corps of Engineers personnel who operate or maintain locks or dams; and the Agriculture bill (HR-5384), both versions of which bar contracting for activities relating to rural development or farm loan programs. The White House opposes each of those restrictions.
