Rules published in the May 13 Federal Register finalize a change in overtime policy primarily affecting certain mid-level managers and supervisors that was enacted in law last year. Under prior policy, a pay cap applied of on and a half times the hourly rate of a GS-10, step 1-a policy that for certain employees meant being paid less for overtime than for regular time. The change, in P.L. 108-136, applies a cap of either the regular rate of pay or one and a half times the GS-10, step 1 rate, whichever is greater. The provision primarily applies to certain managers and supervisors who are exempt from overtime eligibility under the Fair Labor Standards Act but who are eligible for overtime under other laws. The policy is effective as of November 24, 2003.
