Senate Measure Would Restrict NSPS

The Senate Armed Services Committee has voted to repeal the labor relations provisions of DoD’s national security personnel system. According to a committee statement, though, the bill would allow DoD to move ahead with a performance-based pay system and other elements of NSPS, presumably including restricted appeals rights, but only if it is “implemented in a manner that is consistent with existing federal labor laws”—in other words, after negotiation with unions on many provisions. All the employees under NSPS so far are non-union, largely because of a lawsuit challenging the labor relations provisions. The House-passed version would repeal both the labor relations and appeal rights authorities and require bargaining on other elements of NSPS.
