However, House-Senate conferees softened several other restrictions that had been written into earlier versions of the bill. The House had voted to require DoD to create a pilot program of using A-76 to review for work that is currently performed by contractors to see if it should be performed in-house. The final version requires DoD to ensure that consideration is given to using federal employees for work that would otherwise be performed under contract, although A-76 procedures would not have to be used. Conferees also weakened provisions from both earlier versions aimed at strengthening appeal rights by in-house employees. The final version says more time is needed to assess a system created last year in which the management official who prepared the in-house bid can ask the Government Accountability Office to review a contract award.
