As expected, a group of federal unions-led by the American Federation of Government Employees-has filed suit to block portions of the new National Security Personnel System rules that the Pentagon hopes to put in place starting later this month. The suit charges that DoD exceeded its authority under the law allowing it to change many of its personnel practices, in particular by going too far in restricting union bargaining and other rights and by changing employee appeal rights. The challenge mirrors one filed against similar rules at the Department of Homeland Security. Unions have succeeded in getting an injunction against the labor and appeals provisions there that have put the entire set of DHS rules-including pay for performance, and changes in classification and job evaluations-in limbo.
