Various Leave Rules Changed

OPM in the March 15 Federal Register published final rules making several changes proposed earlier in various leave rules. Among other things, the changes: allow SES members to continue their current pay and benefits when accepting a Presidential appointment; allow an employee to use annual, sick or military leave or compensatory time off while performing active uniformed duty; generally require that compensatory time off be used within 26 pay periods; specify that in lump-sum payments for unused annual leave at separation—which are paid out as if the employee were continuing to work for an equivalent period–a night differential is payable for the portion of the lump-sum period that would have occurred when the employee was regularly scheduled to work night shifts; and prohibit the payment of Sunday premium pay to employees during any period when no work is performed, including holidays, periods of paid leave, excused absence (administrative leave), compensatory time off, credit hours, or time off as an incentive or performance award. OPM also indicated that various other changes are still to come.
