OMB Issues Guidance on Use, Risk Management and Other AI Issues

OMB has issued guidance on a range of artificial intelligence-related issues including standards for its use and risk management, pulling together agency responsibilities under several laws of recent years and the Biden administration’s executive order on those issues of last year.

“While AI is improving operations and service delivery across the federal government, agencies must effectively manage its use. As such, this memorandum establishes new agency requirements and guidance for AI governance, innovation, and risk management, including through specific minimum risk management practices for uses of AI that impact the rights and safety of the public,” says memo M-24-10.

Among its requirements are that agencies must:

* designate within 60 days a chief AI officer over the agency’s AI governance, including coordination on policies on data, IT, security, privacy, civil rights and civil liberties, customer experience and workforce management, and establish internal AI governance boards.

* develop an enterprise strategy for how they will “advance the responsible use of AI,” addressing issues related to IT infrastructure, data, cybersecurity, the workforce and the particular aspects of generative AI.

* establishes new requirements that “address the specific risks from relying on AI to inform or carry out agency decisions and actions, particularly when such reliance impacts the rights and safety of the public.”

Agencies further are “strongly encouraged to prioritize recruiting, hiring, developing, and retaining talent in AI and AI-enabling roles” and are to “provide resources and training to develop AI talent internally and increase AI training offerings for federal employees, including opportunities that provide federal employees pathways to AI occupations and that assist employees affected by the application of AI to their work.”

“To protect the federal workforce as the government adopts AI, OMB’s policy encourages agencies to consult federal employee unions and adopt the Department of Labor’s forthcoming principles on mitigating AI’s potential harms to employees,” adds a summary.
