The Federal Labor Relations Authority has upheld an arbitrator’s finding that the Internal Revenue Service’s use of a so-called “good potential” criterion in considering employees for promotion amounted to a prohibited personnel practice, the National Treasury Employees Union has announced.

It said the affected employees would receive priority consideration for promotion because they may have been unfairly screened out for possible advancement by the agency over the past two years.

Those employees would now be entitled for promotion before other candidates and management now carries a burden to select candidates from that pool.

The union, which represents about 90,000 IRS employees, said it would monitor the implementation of the order to ensure promotions are properly awarded.
