The Senate has confirmed the current Republican member of the FLRA, Colleen Duffy Kiko, for another term, lasting into mid-2027, weeks after filling out the agency’s three-member board by confirming former MSPB member and Office of Special Counsel official Anne Marie Wagner to the second Democratic seat.

The nomination of Suzanne Elizabeth Summerlin, formerly with the NFFE union’s general counsel’s office, for the FLRA general counsel position is still pending.

The general counsel decides which cases to bring before the board, an important role as unions seek to overturn a number of precedents the FLRA set during the Trump administration with a Republican majority.

Also currently without confirmed appointees are the top positions at OPM and the Office of Government Ethics, both of which are being filled by an acting official—in the former case, deputy director Rob Shriver, and in the latter, by OGE chief of staff Shelley Finlayson.

No nomination has been made for OPM; David Huitema, currently the senior ethics official at the State Department, has been nominated for OGE director.
