An arbitrator has decided that the Bureau of Customs and Border Protection is obligated to bargain with the National Treasury Employees Union at the national level over changes in assignment and overtime procedures.
NTEU had challenged a CBP management decision not to bargain over such changes after it revised its inspectional assignment policy in October 2001, the union said in a statement.
It also said that while it recognizes management’s right to assign work and overtime, it maintains that the agency is obliged to bargain over the impact of those changes, which can be frustrating to employees.
The arbitrator resolving the national grievance decided CBP continues to have an obligation to notify NTEU at the national level of any local changes, and gave the NTEU and CBP 60 days to determine a remedy.
