Legislation has been offered in the Senate (S-2439) to bar the IRS from rehiring employees who had been fired for poor performance or misconduct—the type of bill that commonly has served as a model for broader ones encompassing other agencies.

The measure was introduced in response to an IG report showing that the agency has rehired employees in that situation, including one with “do not rehire” indicated on the personnel file.

Sponsors said that such hiring actions damage the employees who are working diligently and undermine the public’s confidence in federal agencies.

A similar bill (HR-3724) was introduced in the House late in 2015.
