The IRS is in compliance with a provision in the 1998 restructuring law barring management from evaluating enforcement employees using any record of tax enforcement results, or basing ratings on any goals or quotas, a separate TIGTA report has said.

Based on a sample, the IG said the agency’s efforts to protect taxpayers under that provision are "generally effective and are helping to protect the rights of taxpayers."

"The IRS evaluated all employees on the fair and equitable treatment of taxpayers and prepared quarterly self-certifications" showing that enforcement results were not used to evaluate employees, it said.

The report recommended only a continued emphasis on training, to which agency management agreed.
