The Defense Department has issued new certification form for
employees who file a public financial disclosure report
(SF 278), DoD 5500.7-R, Joint Ethics Regulation (JER), which
requires such employees to certify each year that they are
aware of the restrictions that three statutes place on them
during federal service, when they are negotiating employment,
and after they leave federal service. They are also required
to certify that you have not violated these statutes.
Under the restrictions on negotiating employment, employees
are prohibited from participating personally and
substantially in an official capacity in any particular
matter in which, to their knowledge, they, or any person or
organization with whom they are negotiating or have any
arrangement concerning prospective employment, have a
financial interest, if the particular matter will have a
direct and predictable effect on that interest.
Under the restrictions on seeking employment, personnel may
not participate personally and substantially in a DoD
procurement valued at more than $100,000 when seeking
employment with a bidder or offeror. The rules require that
personnel file written disqualification statements with the
contracting officer, source selection authority, and
immediate supervisor. They must identify the procurement,
describe the nature and specific dates of participation in
the procurement, and identify the bidder or offeror and
describe its interest.
