The office of the deputy secretary of defense has sent out a reminder regarding the restrictions on civilian employees participating in political activities under the Hatch Act, saying that employees “must take care that such participation does not create a real or apparent conflict of interest with the full and impartial performance of their official duties. A rule of particular note is the prohibition against soliciting or receiving political contributions.”
The memo noted that tighter restrictions apply to career members of the senior executive service, employees of intelligence agencies and certain other workers. Further, DoD internal policy places further restrictions on non-career SES members and appointed officials who are subject to Senate confirmation.
The guidance lists prohibited and permitted activities under the Hatch Act and DoD policy, saying that “nothing in this memorandum is intended to encourage or discourage employees’ participation in political activities.” However, it says that before participating in such activities, employees should be familiar with the restrictions and that those with any questions should consult their component’s legal office or the Pentagon’s legal counsel office.
