OMB has issued guidance to agencies on applying ‘Buy America’ preferences in financial assistance programs for infrastructure, including the circumstances in which those preferences can be waived.

Memo M-24-02 revises prior guidance under the Build America, Buy America Act—part of the 2021 infrastructure spending law—which among other things requires that agencies ensure that certain materials purchased under financial assistance program for infrastructure are produced in the United States.

The guidance includes definitions of covered programs, covered recipients and covered materials; applicability of the requirements to sub awards; compliance with international agreements; and standards for waiving the requirements for reasons of cost, lack of availability, or in the public interest.

It also includes standard language to incorporate the requirements into awards.
