OMB has issued guidance to agencies on carrying out the “Permitting Action Plan” issued last year by the White House for environmental reviews and permitting processes for federally funded infrastructure projects.

Among other provisions, that plan encouraged agencies to coordinate early on such projects, to identify and share best practices, and to develop ways to address common issues and eliminate duplication.

Under OMB Memo M-23-14, agencies establish clear timeline goals and track key project information; engage in “Early and Meaningful Outreach and Communication” with other levels of government; share resources to assist project sponsors, applicants and affected communities, submit agency action plans meeting certain criteria; and more.

“Agencies should identify approaches to execute their environmental review and permitting responsibilities for infrastructure projects that are collaborative and seek to harmonize their approach to implementing statutory requirements. These efforts should seek to deconflict requirements such that they prevent process bottlenecks; build common understanding; and contribute to effective, efficient, timely, inclusive, and sound scoping of infrastructure projects,” it says.

The Federal Permitting Improvement Steering Council is to work with agencies “to identify and resolve key issues that cause project review delays, bottlenecks, redundancies, and inefficiencies” and monitor the status of large, complex or significant projects that may warrant special attention.
