The Merit Systems Protection Board as part of its reauthorization proposal has requested the authority allow its employees and administrative law judges to grant motions for summary judgment where in cases determined to have not "genuine issue of material fact."

The National Treasury Employees Union submitted a statement the House federal workforce subcommittee saying the rule change would place too much of a burden on employees lacking experienced legal representation and eliminate the right to a full evidentiary hearing.

MSPB chairman Neil McPhie said the change would help increase the efficiency and effectiveness of the board.
