
President Biden has nominated to fill the vacant seat on the FLRA governing board with Nancy Anderson Speight, currently deputy assistant secretary of defense for civilian personnel policy who previously held several positions within the FLRA including in the general counsel’s office and as director of the Atlanta regional office.
The FLRA has had only two members, split by party, since earlier this year after one of the Democratic members did not seek renomination after his term expired.
Biden also has nominated to be FLRA general counsel Suzanne Elizabeth Summerlin, currently the deputy general counsel and deputy executive director for the Federal Education Association and formerly with the general counsel’s office of the NFFE union. That position oversees union representation elections in the federal workplace, decides which unfair labor practice complaints are brought before the FLRA board, and provides alternative dispute resolution services.
Federal unions have praised the nominations and called for prompt confirmation by the Senate. They are working, with some success during the roughly 18 months the board had a Democratic majority, to have the FLRA backtrack from a number of pro-management rulings it issued during the Trump administration with a 2-1 Republican majority.
