There is some controversy in the federal labor community regarding the lawsuit, with one point of view being that a decision in favor of DoD could set a precedent for restricting union rights that could spill over to other places—in particular, DHS, where a similar suit has succeeded in halting many similar planned changes. Partly because of that concern, they have been concentrating on Congress. The House has passed a DoD appropriations bill that would cut off funding for all aspects of NSPS, although the Senate committee-passed version does not. The House also has voted for certain restrictions as part of a separate DoD authorization bill, and the full Senate could vote soon on its own version that also contains restrictions, although not as severe.
