The delay in implementing the new DHS pay system occurred after a court decision invalidating certain other parts of Max HR, a ruling that remains pending on appeal. While the court granted a prompt hearing on the case, there is no schedule for when a decision will be issued. The lower court’s decision focused on certain labor-management and appeal rights provisions—including blocking the creation of the new in-house labor board–but uncertainty hangs over other parts of Max HR as well, since those rights in many ways are intertwined with how the new compensation system will be designed and carried out, and to what extent decisions on pay can be challenged.
