The legal challenge over the national security personnel system has reached the U.S. Supreme Court, with the American Federation of Government Employees asking the high court to overturn numerous aspects of the NSPS authorizing law, in particular its provisions regarding disciplinary actions, employee appeal rights and union rights in the areas of scope of bargaining and enforceability of contracts. The appeal was filed even though it appears that Congress and the White House are on the brink of enacting a repeal of those provisions. Repeal language was included in a fiscal 2008 DoD authorization bill that President Bush pocket vetoed several weeks ago over an unrelated provision. Congress likely will make addressing that issue one of its first orders of business, and there have been no indications so far that the NSPS restrictions will be stripped out of the bill.
