The hiring of annuitants without an offset under the DoD authority may be either for temporary or permanent positions but an annuitant may not be employed in the same position held prior to retirement except under limited circumstances. The individual need not have retired from DoD to be eligible. The authority applies to hirings after November 23, 2003; there is no retroactive application of the authority. Rehired annuitants who are currently employed but subject to the offset will continue to have their salary offset; when such positions become vacant, the position must meet the criteria in order to be refilled without an offset. Those currently employed under waivers of the salary offset requirement that predate the authority will continue to serve out the terms of that waiver. The requirement to repay any buyout received in the prior five years applies. The DoD guidance sets out who has the hiring authority, in some cases varying according to the level of the person being hired.
