While ruling for the unions on those issues, the judge sided with the Pentagon on several other matters. One involved the portion of the law requiring that the new system be developed in “collaboration” with the unions; unions had derided that process as a sham, but the judge found that the department had not violated the law. The judge also rejected the unions’ argument that the enabling law allowed only limited changes in the labor-management are involving the creation of national-level bargaining and independent review of certain labor practices; the court found that DoD has authority to make broad changes, although ruling that DoD had exceeded its authority in certain areas.
