A recent decision by the U.S. Court of Appeals for the Federal Circuit laid out the test for determining whether an employee who contends a resignation was coerced-a very common complaint–has rights to a hearing before the Merit Systems Protection Board that could result in being reinstated. In sum, the court said that to invoke the Board’s jurisdiction and gain a hearing to determine voluntariness on the merits of the case, the employee need only make a “non-frivolous allegation that, if proven, could establish that his resignation was coerced.
