The whistleblower measure would create a five-year pilot project of allowing appeals to go to circuit courts other than the Federal Circuit. That jurisdiction issue was a major reason that a similar bill failed to gain final approval from during the last Congress—the Justice Department objected to language that would have allowed employees to file appeals in the circuit courts having geographic jurisdiction over them, rather than only in the Federal Circuit, which has national jurisdiction.
