
President Biden has signed into law a bill (S-111) that recently cleared Congress to require each agency, in providing notice of a rule making, to include a link to plain language summary of the proposed rule in no more than 100 words.
Sponsors say the bill would make it easier for members of the public to comment on a proposed rule under the Administrative Procedure Act, especially those who are not experts on the rule’s subject matter.
Meanwhile, the Senate Homeland Security and Governmental Affairs Committee has approved:
* S-2251, to update the Federal Information Security Modernization Act including by setting higher level security protections for federal information systems and their sensitive data, improving cross-agency coordination to protect networks against cybersecurity threats, and require agencies to report all cyber incidents to DHS and major incidents to Congress.
* S-2256, to create a training program in cybersecurity after which participants would be eligible for excepted service appointments into federal positions and would have a service commitment for a time equal to the training period, as well as a training program for military members transitioning to civilian life and their spouses to qualify them for federal cybersecurity jobs.
* S-2032, to target legacy IT systems in use by federal agencies by requiring agencies to develop an inventory of such systems, craft modernization plans to update or dispose of it, under guidance from OMB.
* S-2293, to require agencies to create a strategy for using artificial intelligence, including defining roles and responsibilities, oversight of compliance with privacy, civil rights, information security and other laws.
* S-2073, to require agencies to include a list of outdated or duplicative reporting requirements in annual budget justifications.
* S-2082, to bar agencies from procuring workplace items such as carpeting and furniture containing certain per- and polyfluoroalkyl substances (PFAS) which have been linked to a number of health conditions.
